Elena Kagan has demonstrated a winning sense of humor during her confirmation hearings, but count Democrat Arlen Specter among those unamused. When she refused (as she has throughout the hearings) to provide a detailed response to a legal question, he cut her short to criticize her evasion and warned that he may vote against her confirmation, notes the LegalTimes blog.

“It would be my hope that we could find some place between voting no and having some sort of substantive answers, but I don’t know that it would be useful to continue these questions any further," he said, noting that she herself once called for more open hearings. Losing Specter's report wouldn't derail a confirmation that is "all but assured," in the words of the New York Times. Republicans pressed her again today on everything from Don't Ask, Don't Tell to abortion, but she remained on track. Republican Jon Kyl said a filibuster is "highly improbable."
