A Kansas woman was raped on May 26, 2017, and had a rape kit administered at Atchison Hospital. She told hospital staff her alleged attacker's name—and, she claims, former X-ray technician Janet Rawson Enzbrenner turned around and notified the man that she was accusing him of rape. The woman's lawsuit against the hospital and Enzbrenner also accuses Enzbrenner of "gain[ing] access to plaintiff's individually identifiable health information" and leaking it to the alleged rapist, who then "relentlessly harassed plaintiff through text messages, social media and phone calls" and ultimately sexually assaulted her again months later, NBC News reports. The suit also accuses Enzbrenner of harassing the woman, Fox4KC reports.
The lawsuit includes a letter from the hospital's CEO that acknowledges "this employee ... did access some of your health information and apparently did disclose it to another individual without your permission," and the CEO tells NBC News the hospital acted quickly after the breach: "When we were made aware of the situation, we took immediate steps to investigate, and within two days, we terminated this individual's employment." The Kansas City Star, however, reports the woman was hired by another hospital. It's not clear how or whether Enzbrenner knew the alleged rapist, who was never charged. A representative for the Atchison County Attorney says authorities were notified about the alleged rapes, but did not elaborate on why charges were not filed. (More lawsuit stories.)
