A white Ohio woman mistakenly provided with sperm from a black man is suing the sperm bank she says is responsible…again. Reuters reports Jennifer Cramblett filed the new lawsuit in federal court on Friday. It claims the Midwest Sperm Bank committed negligence, fraud, and misconduct when it provided her and her partner with the wrong sperm resulting in her giving birth to a mixed-race daughter in August 2012. She's seeking more than $150,000 in damages. Cramblett's previous suit, which claimed wrongful birth and breach of warranty, was thrown out in September after a judge ruled neither of those applied in the case of a healthy baby.
Her current lawsuit claims she, as a white woman, isn't prepared to raise a mixed-race baby, which brings "numerous challenges and external pressures." According to her first lawsuit, those challenges and pressures include a racist community and an "unconsciously insensitive" family that is already having a hard enough time with her being a lesbian. Cramblett's first lawsuit took pains to make it clear that none of this means she doesn't love her daughter. (More sperm bank stories.)
