Roger Clemens Must Face New Perjury Trial

A federal judge today rejected ex-baseball star Roger Clemens' request to throw out perjury charges against him and said he must face another trial. US District Judge Reggie Walton set the date for April 17. The first trial ended in a mistrial on only the second day when prosecutors showed barred evidence. Clemens' attorneys argued that the offense was so bad that Clemens should not face a second trial, but the judge disagreed.

“While I am very troubled by what occurred and it was something that should not have taken place, I just think that the current state of the law would not justify me concluding on the record we have in this case that the double jeopardy clause bars re-prosecution," said Walton.
